Terms and Conditions

Panora Tours and Safaris offer Kenya Tour packages and other services including: tour logistics, hotel bookings, flight ticketing, honeymoons, car hire, family travel, electronic visa Kenya and others. The activities we offer include : hiking, bird watching, nature trails, road trips,city tours,excursions, mountain climbing safaris, cultural Africa safari. These terms and conditions apply to all tours/safaris/trips and excursions offered by Panora Tours and Safaris Ltd. Hereby also referred to as The Company/Safari Company to clients/guests / passengers/Tourists.

TRAVEL DOCUMENTS

It is of utmost importance that you thoroughly check your electronic visa Kenya requirements before your intended date of travel.

Panora Tours and Safaris Ltd will not take responsibility if the client fails to fulfill the necessary visa requirements. The client must have valid travel documents, including a passport, electronic visa for Kenya, vaccination certificates, and any other flight requirements set by the airline. We will not refund fares or provide compensation if the client is refused entry into a country for any reason.

BOOKING AND PAYMENT

You can make all reservations by email, phone, or by visiting our offices. We will confirm bookings only after you pay a 50% deposit of the total amount. You must pay the balance no later than 45 days before the start of the tour/safari. If you make a booking less than 45 days before the tour, you must pay the full amount. You should make payments net of all bank charges, both for sending and receiving. You can make payments via cheques, Lipa na M-Pesa, or Visa.

Credit card payments will attract a 5% bank surcharge.

If the bank returns a cheque issued by the client for any reason, the client must replace it with certified funds within seventy-two (72) hours. We will charge a fee of USD 50.00 for any returned cheque. We will send credit card payment details to clients through a link to enable online payment.

CANCELLATION POLICY

Cancellation or reduction in the number of days must be notified in writing. It will take effect the day it is received by Panora Tours and Safaris Ltd. Cancellation fees will be due and payable as below:

  1. Between 61 & 75 days, 15% of the total cost will be charged
  2. Between 45 & 60 days, 25% of the total cost will be charged
  3. Between 31 & 45 days, 50% of the total cost will be charged
  4. Between 30 days & a ‘No Show’ 100% of the total cost will be charged.

No refund is available for cancellations after commencement of tour arrangements or on any services not used.

TRAVEL ARRANGEMENTS.

Travel arrangements like electronic visa Kenya, flight,hotel and transport reservation made by the company are subject to booking and cancellation provisions of supplier. We reserve the right to amend our rates in the event of changes in direct costs to us.

INSURANCE

Client should have Comprehensive travel and medical insurance covering his/her personal requirements. The insurance should cover following but not limited to: cancellation of safari and services booked, emergency evacuation, medical, repatriation, damage/theft/loss of personal baggage, money and goods. The Company including their representatives, will take no responsibility for any costs or losses incurred by the guests their dependents or traveling companions, with regards to, but not limited to, any of the above mentioned eventualities.

Guests will be charged directly by the relevant service providers for any emergency services they may require. Please note that credit card travel insurance is inadequate for tours in Kenya. The choice of insurer is the sole discretion of the client.The client acknowledges that services arranged by the company, whether in civilized or remote areas by plane, vehicle, train, boat, horseback, foot or other conveyance contains inherent risks of injury. Illness, death, or loss and damage to property, which may be caused by forces of nature, accidents, wild animals, negligence of others, and other causes known or unknown.

The tourist acknowledges that such risks may be present at any time before, during or after the tour and that medical service and facilities may not be readily available during the tour. The customer expressly assumes any and all risks with respect to the activities and circumstances described herein and the company will not liable on account of any losses, claims, costs, liabilities or damages.

HEALTH

The client acknowledges being aware of the proposed itinerary and ensures that he/she is medically fit and able to participate in the tour. If sickness or an accident interrupts a Kenyan tour, the company will not be liable for any costs arising from it, unless the sickness or accident was caused by the operator’s willful act or gross negligence. The company will not provide any refund, either in total or partial. Please inform us well in advance if you have any special dietary requirements.

INDEMNITY

Panora Tours and Safaris Ltd acts as an agent in packaging tours in Kenya and other travel arrangements utilizing the products of various travel suppliers. The company strives to engage quality suppliers, including airlines, hotels, and other service providers, to ensure that the services for each tour are carried out efficiently and as specified. However, the company does not directly control the services provided by the operator, the supplier, or their employees. The company will not be liable for any loss, damage, injury, additional cost, delay, or irregularity caused by any error, default, act, or omission of any supplier while arranging the tour or in connection with it, except in cases of willful negligence or willful acts or omissions.

If the company appoints a tour leader or guide for any tour, the client must follow all reasonable instructions given by the tour leader or guide.

Panora Tours and Safaris Ltd will never act as the agent for the passenger or the supplier of any service. Panora Tours and Safaris Ltd believes that the contents of this website are accurate at the time of publishing, but we may change or withdraw all prices and services without notice. The Safari Company will not be responsible for loss or damage arising from any errors or omissions contained in its website, literature or information sources.

PASSENGER RESPONSIBILITY

Passengers must not carry any unlawful articles or substances while traveling. If any passenger offends against the prohibitions set out herein, the operator will be entitled to immediately exclude from the tour the offender who will be responsible for his or her own repatriation and all costs thereof. The operator will under no circumstances assist any such offender in any dealings or negotiations with any authority. Jurisdiction In all matters where it is or may be necessary to have recourse to the Court, the Courts of the Republic of Kenya shall have sole jurisdiction to the exclusion of the Courts of any other country and the prevailing law of the Republic of Kenya shall prevail concerning all tours.

Travellers are solely responsible for complying with the formalities required by police, customs, health, and all other authorities at the point of departure, at the destination, and while in transit. The company may, at its discretion and without liability or cost, decline, cancel, or terminate the guest’s booking if the client is ill, engages in illegal activity, fails to pay any amount due, or interferes with other members of the group or causes any disturbance or nuisance. In such cases, the client will not be entitled to any refund. The client agrees to comply with a reasonable code of conduct during the safari and will not create a nuisance for other persons on the tour.

PRICE INCREASE

The Safari Company reserves the right to increase their tour fares due to any increase in airline flight tariffs, fuel costs, game reserve entry fees, fluctuation of exchange rates, government actions and other factors beyond the companies control. The company will use its best endeavors to provide all tours as confirmed, reasonable changes in the itinerary may be made without notice if necessary.

RESERVE ENTRY & CONCESSION FEES

You must pay reserve entry and concession fees at the time of reservation. These fees are subject to change on short notice, as they are controlled by the Kenya Wildlife Service or other facility officers. We will pass on any changes in full, even for pre-paid clients. ALTERATION OF ROUTES AND SUBSTITUTION OF ACCOMMODATION

The company reserves the right to alter or substitute routes,meals, accommodation, itineraries, tours, services, flight changes,vehicles and arrangements in case of conditions beyond our control. Such cases like/ but not limited to road conditions, weather, mechanical breakdown, accident, border closure, local politics or a multitude of other factors. In case of alterations, the leader will decide on the best alternative based on the best interests of the clients. We will do everything possible to minimize the effect, but we can’t be responsible for the results of changes or delays. The Company takes every care to ensure that itineraries are followed to the letter but unforeseen circumstances may necessitate changes.

We accepts no liability due to the alteration of routes or substitution of properties. If we substitute properties or services, we will offer substitutes of equal value and standard and inform the client of any known changes before departure. The company has the right, at its discretion, to cancel any safari or services, or the remainder of them, or make alterations to the route, accommodation, price, or other details. If any safari or services become impossible, illegal, or inadvisable due to weather, strike, war, government interference, or any other cause, the client must bear all extra expenses incurred, including but not limited to the cost of returning home, alternative accommodation, food, personal expenses, and all resulting costs.

FLIGHT AND TRANSFERS

We advise guests to pack in soft bags with a maximum weight of 15kg per person for internal flights within Kenya during their tours. We can arrange transfers to additional destinations, and prices and durations will vary depending on the length of the journey and the condition of the access roads, including for the electronic visa to Kenya

INTERNATIONAL AND DOMESTIC FLIGHT BOOKINGS

Reconfirmation of electronic visa Kenya, flight bookings is the responsibility of the traveller. As tour arrangements may be booked to connect with international and domestic air flight it is your responsibility to keep us updated as to your flight times and numbers.

DISPUTES

The client must bring any claim or dispute that arises between them and the company, including claims for loss or damage due to injury to person or property, to the attention of Panora Tours and Safaris Ltd before their departure to resolve the issues on the ground. If this is not possible, the client must follow up in writing no later than 14 days after the tour, and the Kenya legal system will apply exclusively.

By attending our Kenya tours, you consent to being photographed, filmed, and/or recorded as part of the group. We may use and distribute all photographs, videos, and any other recorded materials without any form of payment to you.

In use of such materials, Panora Tours and Safaris shall not be liable for any injury,damages or loss that may arise.PAYMENT OF A DEPOSIT WILL INDICATE AN ACCEPTANCE OF THESE BOOKING CONDITIONS BY THE PASSENGER/CLIENT.
